GENERAL TERMS AND CONDITIONS FOR PURCHASING VOUCHERS

§ 1 APPLICABILITY AND CONCLUSION OF CONTRACT

(1) These general terms and conditions (GTC) apply to all contracts between the customer and HHM Hannover Hotels Management GmbH, Karl-Wiechert-Allee 68, 30625 Hannover (Wyndham Hannover Hotel Atrium) for the purchase of vouchers.

(2) The GTC do not apply to booking hotel rooms directly or to booking rooms or blocks of rooms for events (e.g. conferences, seminars, etc.).

(3) The amenities shown on the hotel website are not a binding offer of contract but are merely an invitation for customers to submit an offer. The contract is realised by the customer entering and submitting his order information and then downloading or printing the voucher with unique barcode generated by the hotel.

§ 2 VOUCHER

(1) The vouchers purchased have a barcode providing information about valid dates and its value when read out. The customer may print the voucher multiple times. The value of the voucher may only be redeemed once.

(2) Lost vouchers will not be replaced. Vouchers cannot be returned for cash value.

(3) When redeeming the voucher the hotel verifies the respective barcode was actually generated by the system and has been paid for. The hotel is not obligated to accept unpaid vouchers for payment.

(4) If the value of the voucher is higher than the services used, the remaining value will be recorded in the internal computer system. Vouchers may be redeemed for partial amounts. There is no entitlement to cash payout of the remaining voucher value.

(5) In the event the hotel for which the voucher was purchased closes for any reason or changes operating companies before the voucher is redeemed, the customer is no longer entitled to redeem the voucher. The voucher value may instead be refunded during the time the voucher is valid.

§ 3 PAYMENT

(1) Vouchers are purchased online and paid via credit card or PayPal. The hotel reserves the right to exclude specific payment methods in individual cases.

(2) Vouchers are e-mailed free of charge and may then be printed out by the customer. In the event payment is not made in a timely manner or for the full amount, the hotel is entitled to reserve the services confirmed in the voucher until full payment has been received.

§ 4 VALIDITY

Vouchers are valid for three years from the end of the calendar year during which they were purchased. The value of the voucher may be redeemed during this validity period.

§ 5 TRANSFERABILITY / NO COMMERCIAL RESALE

(1) Vouchers are not issued to a specific person and may be transferred to other individuals.

(2) The commercial resale of vouchers is strictly prohibited.

§ 6 CANCELLATION

(1) When purchasing vouchers through the hotel website, consumers are by law entitled to rescission. The cancellation policy and a cancellation sample can be found at the end of these GTC.

(2) In the event the customer or the person redeeming the voucher is unable to redeem the voucher for reasons for which the hotel is not liable, the customer or the person redeeming the voucher is responsible to use the voucher otherwise (e.g. by giving it to another person). Vouchers are not refundable when expired or after the statutory cancellation term without legal cause for cancellation.

§ 7 DATA PROTECTION

(1) Personal information about the customer may be collected, saved, processed and disclosed for order processing purposes. Personal information will only be used specifically to fulfil the contract.

(2) Any data such as credit card number, routing number, account number, name and address when paying by credit card are transmitted through certified payment service providers using their secure SSL connections and in accordance with the PCI regulations. Unauthorised persons are unable to gather the data provided by the customer during transmission. Data is processed EDP-supported. Customer data will not be disclosed to third parties.

(3) Please also note the hotel’s privacy notice in this respect.

§ 8 FINAL PROVISIONS

(1) In the event individual terms of these GTC are or become null or void, this does not affect the remaining terms. Furthermore, the statutory provisions apply.

(2) Subject to the German law. Application of the UN Convention on Contracts for the International Sale of Goods is excluded.

Cancellation Notice

When entering into distance selling contracts, consumers are legally entitled to cancel unless the right has been excluded by way of exception or has lapsed.
Please refer to item 1.4 of the GTC for the term “consumer”.
“Distance selling contracts” are contracts where the seller or a person acting on his behalf and consumers only use means of distant communication to negotiate and conclude a contract, unless the contract is not concluded through a sales or service system set up for distance selling.
“Means of distant communication” is any means of communication which may be used to initiate or conclude a contract without the parties both being physically present, such as mail, catalogs, phone calls, fax, e-mail, messages sent via mobile services (SMS) as well as broadcasting and telemedia.

Cancellation

You are entitled to cancel this contract within fourteen days without specifying a reason.
The cancellation period is fourteen days from the day when you or a person assigned by you, except the carrier, receive(d) the goods.

an explicit statement (e.g. a letter sent via mail, fax or e-mail) notifying us of your decision to cancel this contract. The enclosed cancellation form may be used but is not mandatory.
To keep the cancellation term you will only need to send the notification of exercising your right to cancel prior to the end of the cancellation period.

Results of cancellation

After cancelling this contract, we are obligated to refund all payments received from you including delivery costs (except for additional expenses for delivery methods other than the low cost standard delivery offered by us) immediately, but no later than within fourteen days from the day we received your notice cancelling this contract. Refunds will be made using the same method of payment used for the original transaction unless specifically agreed otherwise with you; you will never be charged for this refund.
We are entitled to refuse a refund until goods have been returned or you have provided documentation the goods have been returned, whichever occurs first.
Goods must be returned promptly and at any rate no later than within fourteen days from the day you notified us of your cancellation. This term has been kept when goods are sent back before the fourteen day term expires.
You are responsible for the actual costs of the return shipment.
You are only liable for any depreciation of goods if this depreciation can be attributed to handling the goods in a manner not necessary to inspect their quality, properties and functionality.
Unless otherwise agreed between the parties, the right to cancel specifically does not apply

  • to contracts related to the supply of goods which are not ready-made and which require the customer to make a selection or specification or which are clearly customised to the personal needs of the consumer; and
  • contracts to provide lodging services for non-residential purposes, transport goods, vehicle rental, supplying food and beverages, as well as to provide other services related to recreation, if the contract includes a specific date or period for providing the service, although here the right to cancel is not excluded for contracts related to travel services according to § 651a, concluded outside of offices, unless the verbal negotiations resulting in the conclusion of contract were held following a previous order from the consumer.
